Terms of Use
Last updated: October 2026
DRAFT for review. Not yet in effect; must be reviewed before publication.
These draft terms cover your use of the Clincher iPhone app and this website.
What Clincher is
Clincher is a productivity tool for agents. It is not legal, tax, financial or inspection advice, and it does not replace your broker, a closing attorney, a title company, a lender or a licensed inspector.
Estimates and AI drafts
Any estimates in the app should be confirmed with your closing attorney or title company. Parties and deadlines read from a contract may be incomplete or wrong; check them against the source documents. AI drafts are suggestions. Review them before you use or send them. You are responsible for what you send to clients and other parties.
Your account and content
You keep ownership of the content you put into Clincher. You confirm you have the right to enter information about your clients and other people, and that your use complies with applicable law, your brokerage's policies and any MLS rules.
Subscriptions
Subscriptions are purchased through the App Store and renew automatically until canceled. Manage or cancel anytime in your Apple ID settings; you keep access through the end of the current period. Refunds are requested through Apple and follow Apple's refund process.
Acceptable use
Don't misuse the service, try to break its security, or use it to send spam or unlawful content.
Disclaimers and liability
Provided as-is. Our total liability is limited to what you paid in the last 12 months. Governed by Tennessee law, with disputes handled in Davidson County, Tennessee.
Changes
We may update these terms. We will change the date above when we do.
